PLV Conference 2023 Competition – Terms and Conditions
This competition is open for public libraries and public library services located in Australia to win a 6-month subscription of Era Books Online for the benefit of their library members. Entries may be submitted by employees and associates attending the PLV Conference 2023. There is 1 x prize to be won.
- Information on how to enter and the prize form part of these Terms and Conditions (Terms). Participation in this competition (Competition) is deemed an acceptance of these Terms.
- The Competition promoter is Storytime PODs Pty Ltd (ABN 93 165 833 983), creator and operator of Era Books Online, with its head office located at 3/6 Riddell Parade, Elsternwick VIC 3185 Australia (Promoter).
- Entry is only open to registered attendees of the PLV Conference 2023 taking place in May 2023 (Conference).
- Registered attendees can enter the competition on behalf of a public library or public library service located in Australia (Public Library Service), as an employee, officer, consultant or associate of the Public Library Service (Entrant). Persons who are minors (younger than the age of legal consent) are ineligible to enter.
- The Competition is open for entry during the Conference, which commences on Thursday May 11, and closes at midnight (Melbourne time) on Monday May 15 (Promotion Period). The winner will be drawn at 11:00 AM (AEST) on Tuesday May 16 at the Promoter's head office. The Promoter's decision is final and no correspondence will be entered.
- Entrants must, during the Promotion Period, complete the competition entry form located at https://www.erabooksonline.com/conf006/ (Form), and accept these Terms. To be eligible, Entrants must answer the required questions and provide valid Name, Public Library Service Name and Email Address details in the Form.
- In the event that multiple Entrants enter the Competition on behalf of a Public Library Service, the number of Competition entries for that Public Library Service will be capped to the first 3 entries submitted.
- Competition winners will be determined by draw. The first 1 x valid entry drawn will win a 6-month subscription to Era Books Online for the Public Library Service (Prize). Each Prize is nominally valued between AU$500 and AU$3,000 depending on the size (population served) of the Public Library Service. The Prize includes all standard advertised benefits provided by the Era Books Online subscription, and no additional benefits.
- The Promoter reserves the right, at any time, to verify the validity of entries and to disqualify any Entrant who submits an entry that tampers with the entry process or Competition or is not in accordance with these Terms. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Entrant winners will be notified using the Email Address and Phone Number provided on the Form within 48 hours of judging.
- Names from winning entries (Entrant and Public Library Service) may be published, and the winners shall participate in any publicity activities regarding the Competition if requested by the Promoter.
- The Promoter accepts no responsibility or liability for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a consequence of the Prize except for any liability which cannot be excluded by law.
- Unless expressly stated within these Terms, all expenses incurred in relation to the Prize (including tax implications) are the responsibility of the winners.
- In the event that for any reason whatsoever the winner Entrant or Public Library Service does not claim or accept the Prize by the time and under the terms stipulated by the Promoter, then the winner Entrant and Public Library Service will forfeit the Prize, and cash will not be awarded in lieu of the Prize.
- In the event that a Prize is not claimed or accepted, a second judging will be held 3 months after the original prize draw at 11:00 AM (AEST) on August 15 at the Promoter’s head office. Winner/s from this judging will be notified in the same manner as set out in clause 10 of these Terms.
- Any cost associated with claiming, administering or promoting the Prize for the benefit of members of the Public Library Service is the responsibility of the Public Library Service.
- Nothing in these Terms, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under laws of the relevant jurisdiction. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
- If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant or Public Library Service; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
- The Promoter will comply with all relevant privacy laws in connection with the Competition. Entrants acknowledge and agree that personal information, as that term is defined in the Privacy Act 1988 (Cth) or any other applicable privacy legislation, collected in connection with the Competition is governed by our privacy policy located at https://www.erabooksonline.com/privacy-policy/.
- These Terms shall be construed and interpreted in accordance with the laws of the state of Victoria, Australia and Entrants and Public Library Services submit to the non-exclusive jurisdiction of courts of the jurisdiction.
